This is not a payment and your card will not be debited while this transaction. If your max bid is the winning bid, the amount of €600 will then be debited in the form of a deposit; the remaining amount of the invoice will be payable before delivery of the vehicle. ALCOPA AUCTION reserves the right to suspend any customer account at any time.
If you are unable to follow the auction either in the room or via Live, you may submit a max bid via our website, which authorises Alcopa Auction to bid on the vehicle of your choice on your behalf during the sale.
A deposit of 600€, will be requested while the registration. This is not a payment and your card will not be debited while this transaction. If your max bid is the winning bid, the amount required while the registration will then be debited in the form of a deposit; the remaining amount of the invoice will be payable before the delivery of the vehicle.
Max bids submitted via the internet for physical sales are automatically blocked 15 minutes before the start of the sale.
Note: Some professionals of the automotive industry can benefit some specific conditions, including NO need to make a credit card imprint for a deposit of €600 when depositing a max bid.
Alcopa Auction organises and runs publics auctions for vehicles using online and distance selling methods, which are governed by the provisions of the following terms and conditions.
This electronic auction method is compliant with the legislation on public auctions in effect in France and more specifically, Act no. 2000-642 of 10 July 2000. The sales system is the property of Alcopa Auction, an auctioneer registered with the French Auction Market Authority (Conseil des ventes volontaires aux enchères publiques) O.V.V. no. 018-2012.
An internet user who views the data provided by Alcopa Auction on their screens but does not sign up on the site is known as a visitor.
An internet user who registers on the site for the purpose of bidding on lots they wish to purchase is known as a bidder.
The internet user who submits the highest bid at the end of the auction period and to whom the item is sold is called the winning bidder.
Any user who seeking to bid on the internet must register on the website using their personal or company details. They shall assume all liability for any false declarations.
The banking information of the internet user will be registered through a banking website that uses a secure “SSL” system. Alcopa Auction will not have access to the bank details of registered users.
The bank information will be required when you bid on the vehicle or vehicles that interest you.
Users choose a personal, confidential code when they register that allows them to submit bids. They may be held liable if they disclose their personal code to another person.
The personal data provided are not disclosed to any third parties, either individuals or legal entities.
Visitors must accept these General Terms and Conditions of Sale of the Alcopa Auction.
Only people with full legal capacity are permitted to register on the site.
The public auctions are reserved for people who are over the age of majority.
ALCOPA AUCTION reserves the right to suspend any customer account at any time.
Alcopa Auction’s liability is limited to implementing the necessary resources for the smooth running of the auction.
The auctioneer acts in its capacity as the seller’s agent and is therefore not a party to the sale, which binds only the buyer and seller of the lot.
The photographs and descriptions of vehicles shown on the site are considered as advertising fulfilling the statutory requirements for public auctions. Vehicles are sold in “as is” condition and all equipment are provided for indicative purposes with no checks as to its good working order, as submitted to the auctioneer, with the corresponding registration document or certificate. A technical check is carried out by an independent organisation chosen by Alcopa Auction and is available on the website.
Confirmation of these General Terms and Conditions of sale implies acceptance of said terms and conditions and of the sale costs.
The only personal data collected are those submitted voluntarily when creating your account.
The information gathered is processed electronically for internal use and the smooth operation of your customer account only.

Alcopa Auction reserves the right to withdraw any vehicle after the start of the auction, where there is an argument or dispute.
The descriptions and images shown on the website are the property of Alcopa Auction SAS and cannot be reproduced for commercial purposes without the express authorization of their owner or their beneficiaries.
Only registered users may submit one or more bids. The time of the auction is Paris time.
A countdown is displayed on the sale and each vehicle information page. The bid increment set by Alcopa Auction is €100 incl. tax.
The fact of submitting and confirming a bid is binding on the bidder and makes them the owner of the vehicle at the fall of the hammer, if no higher bid was submitted after them.
The amount of the higher bid is shown on the vehicle information page. If two bidders submit the same bid, the first bid recorded is accepted.
Alcopa Auction reserves the right to repurpose any bid it deems doubtful, for any reason whatsoever.
Bidders are deemed to be acting on their own account even when acting as an intermediary, and may be held personally liable.
All bids are confirmed by email, as they are may result in the item being sold to the person submitting them. The winning bid is pronounced on the basis of the “no bid” principle at the date and time stipulated on the vehicle information page.
The winning bid cannot be pronounced before the stated time for the end of the auction.
It is pronounced automatically if there have been no bids in the final 10 minutes of the time allowed.
If a bid is submitted within the final 10 minutes, the hammer will not come down for a further 40 seconds from the last bid.
This procedure is repeated until there are no more bids within a period of 40 seconds.
The winning bidder receives an email with an invoice. Please note that a bank card imprint is required in order to bid during the auctions.
The property is automatically transferred at the fall of the hammer and the item become the responsibility of the winning bidder from that moment. Unlike with traditional e-commerce websites, the purchase is confirmed by the fall of the hammer and not at the point of payment.
All the non-runner vehicles of the sales of "non-runner" don’t have technical inspection and are strictly reserved for automotive professionals; private customers or companies cannot participate in the auction. Alcopa Auction has the full right to cancel your offers on these types of vehicles.

For bids placed via the website for physical sales, auction and sale costs are in addition to the hammer price. The percentage of auction costs will be applied according to the vehicle category as indicated above.
Attention, for all the winning max bids placed via our website, the LIVE sale cost of €40 incl. tax (i.e. €33,33 excl. tax) per vehicle sold will be added to the hammer price.
For bids placed via our Alcopa LIVE platform and via the website of our partner INTERENCHERES at the same time as physical auctions, the auction and sale costs are payable in addition to the hammer price. The percentage of auction costs will be applied according to the vehicle category as indicated above.

Physical auctions
If your max bid is the winning bid, the invoice should be collected directly from the reception desk for vehicles bought in the auction room. For Live auctions and bids, an email containing a description of the vehicle and its total purchase price will be sent to the winning bidder after the sale. The invoice will be available within 24 to 48 hours after the auction.
All winning bidder who want to change their name on the invoice must submit their request before the payment of the lot, with a deadline of 3 days after the auction. When submitting their request, they must provide a national identity card, driving licence and proof of address.
Web sales
If your max bid is the winning bid, you will receive an email containing a description of the vehicle and its total purchase price. The invoice will be available within 24 to 48 hours after the auction.

The winning bidder shall own and be responsible for their purchase as soon as the fall of the hammer. The buyer is responsible for insuring the vehicle as soon as the fall of the hammer.
20% VAT and sale costs are included in the hammer price.
If the vehicle information sheet states “VAT recoverable: yes”, it can be recovered by buyers who are subject to VAT. Otherwise, there will be no VAT information on the buyer’s note and it will not be recoverable.
The auction house shall be exclusively responsible for judging whether a bid is irresponsible or not and may immediately proceed with the resale of the lot in any location and on any day and at any time that it may deem appropriate, without the need for any formality or expense, at the risk of the defaulting successful bidder. In the event of a difficulty arising with a payment, this procedure can be continued at a later date.
The original administrative documents will be handed over with the vehicle once the payment has been made. If these are unavailable, it may take up to 15 days to receive them. In this case, the documents will be sent to the address indicated by the buyer.
Public sales in an auction room (apply to all format of sales: physical auction, Alcopa LIVE and max bid via our website) are explicitly excluded from scope of the right of withdrawal by order no. 2001-741 of 23 August 2001 (Art. 121-17 of the French Consumer Code).
Based on this principle, each bid placed and each sale is final.
A winning bidder who would refuse to assume their obligations would be at risk of judicial proceedings and their immediate and permanent exclusion from Alcopa Auction SAS auction room.
The deposit at the time of the auction will be acquired by SAS Alcopa Auction, no matter what type of sale and type of vehicle, the vehicle will be put back on sale by its mandator with a risk of lost
The vehicles must be paid for within 3 days after the auction.
Fixed compensation of €40 is payable in the event of late payment (Art. D441-5 of the French Commercial Code).
After this, the parking costs of €40/vehicle/day will be charged.
We accept the payment by bank card or bank transfer only. For security reasons, no cash payments/cheque/bank cheque will be accepted.
Note: Any vehicle that has not been paid 8 days after the auction will be put back on sale and the deposit will be permanently lost. The parking fees of €40/day will be charged for any vehicle that has been paid for but not collected within 4 days after the auction. No claims will be accepted.
For private individuals, a proof of the address less than 3 months old will be required to issue you with the invoice.
Alcopa Auction uses the PayZen solution from Lyra Network for scanning your payment card. This is PCI-DSS certified and offers maximum security through 3D Secure.
The payment card information is encrypted through the SSL protocol (https) and never transmitted over the internet unencrypted. The personal data entered on our site are confidential. Alcopa Auction does not have access to your full payment card number at any time.
The bank cards accepted are CB / E-CARTE BLEU / MAESTRO / MASTERCARD / VISA / VISA ELECTRON.
The bank card imprint made with Payzen to participate in a sale are not collected before the auction of a lot, neither Payzen or Alcopa Auction are responsible if the banks decide to collect or block the value of the bank card imprint.
ALCOPA AUCTION commits to provide the details listed below for each vehicle put up for auction.
ALCOPA AUCTION commits to provide a detailed commercial description for each vehicle presented for auction. However, this is provided for information purposes only and does not therefore guarantee the list of equipment that is included or optional in the finished model.
As part of the Auctions held by ALCOPA AUCTION, some trade photographs accompany each vehicle description, to allow you to properly assess the general interior and exterior condition of the vehicle. However, it is possible that some minor defects may not be visible on the photographs. Nevertheless, these photographs are the exclusive property of ALCOPA AUCTION and must not be reused by third parties.
ALCOPA AUCTION requires each running vehicle to undergo a roadworthiness test performed by approved and independent technical centers; they are displayed on the vehicles before and during the sales, or may be consulted and downloaded on the vehicle’s web page on the website as soon as the sale is placed online. Non-running vehicles are sold without a roadworthiness test, generally in a specific sale and intended only for businesses in the auto trade.
The reclamation costs attached to the technical inspections will be at the expense of the buyer and must be made before the application for registration in case of follow-up inspection. It’s therefore mandatory to take knowledge before participating in the sale, any buyer is renowned to have read the technical inspection. Any claim relating to the defaults announced can’t be taken into account.
There are 3 levels of defect:
Consequently, a vehicle whose technical inspection have identified critical defects must be collected on a breakdown truck.
a) The “Information” section of the description sheet provides all customers with additional details about the lot. These details may refer to various parts marked “to check”. It is agreed that the costs of repairing the parts marked “to check” on the description sheet are to be borne by the buyer.
If applicable, any parts “to check” listed in the “information” section will be included on the invoice.

Possible causes: Lack of GPS mapping or any other defects in a component of the multimedia system, subject to other faults.
Sunroof – panoramic roof – retractable roof – soft top to check:
Issues: Sunroof – panoramic roof – retractable roof – soft top is/are faulty or not working
Possible causes: Marks or cracks, faulty mechanism, motorization, power supply or any other defects in a component of the Sunroof – panoramic roof – retractable roof – soft top system, subject to other faults.
Clutch to check:
Issues: Clutch system is faulty or not working
Possible causes: Worn clutch disk, faulty mechanism, faulty engine flywheel or any other defects in a component of the clutch system, subject to other faults.
Engine noise to check:
Issues: Abnormal noise coming from the engine compartment.
Possible causes: Faulty engine or component, or any other defects in a component inside the engine compartment, subject to other faults.
Coolant liquid to check:
Issues: Lack of liquid or incorrect liquid color/consistency
Possible causes: Lack of, leakage or clogging of coolant, pressure in the system, faulty cylinder head gasket or any other defects in the cooling system, subject to other faults.
b) The “Comments” section of the description sheet provides all customers with additional details that ALCOPA AUCTION considers useful to provide about the lot. It is agreed that the costs of repairing the details included in the “Comments” section are to be borne by the buyer.
If applicable, any details “to check” mentioned in the “Comments” section will be included on the invoice.
Alcopa Auction has partnered with Icare Assurance to provide a 3-month Mechanical Breakdown Warranty Extension for used car as follows:
This warranty has no excess, imposes no cap on any repair work and includes assistance in the event of a breakdown.
For automotive businesses, the warranty may be transferred to the end buyer who is the beneficiary of the Alcopa Auction warranty.
Attention, the warranty extension ICARE doesn’t apply to the vehicles in the following case:
This warranty is included with vehicles that are less than 5 years old and have less of 150,000 km.
This warranty is included with vehicles that are more than 5 years old or have more than 150,000 km and that are less than 10 years old and have less than 200,000 km.

The vehicles purchased must be pickef up within a maximum of 3 days following the sale. The parking fees with a amount of €40/day will be charged after this time.
The buyer is responsible for insuring the vehicle as soon as the fall of the hammer.
Equipment
The winning bidder shall own and be responsible for their purchase as soon as the fall of the hammer. They have 7 days to pick it up. The parking fees with an amount of €40 per day will be charged after this time. The equipment may only be picked up after being paid.
The buyer is responsible for insuring the vehicle as soon as the fall of the hammer.
When collecting the vehicle, you will be asked for the RELEASE NOTE (or consignment note/CMR), and this document will only be issued to you after all the amounts due to ALCOPA have been paid in full. No vehicle can be removed without the RELEASE NOTE (or consignment note/CMR).
When collecting the vehicle, you are given 3 minutes to visually inspect each vehicle, and after this period the RELEASE NOTE (or consignment note/CMR) must be dated (with the precise time) and signed by both parties to be valid. Any reservations that could be the subject of a claim must be entered legibly onto the RELEASE NOTE (or consignment note/CMR).

The winning bidder must complete or appoint a forwarding agent to complete all the necessary export formalities in respect of vehicles sold for export or which require particular customs formalities.
The exports of vehicles outside the European Union must be completed by the end of the third month following the month in which the sale was completed.
The VAT can only be reimbursed by bank transfer and only on presentation of the EX1. Note: any EX1 that refers to an EUR1 must be accompanied by a certificate of compliance justifying the declaration of preferential origin, which is the responsibility of the winning bidder. VAT cannot be reimbursed without this document.
Individual buyers purchasing a vehicle for export must approach a forwarding agent within 4 days after the auction. Within these 4 days:
The forwarding agent will complete the necessary formalities with the individual buyer and its own tax office in respect of export formalities and reimbursement of VAT.

Any purchase of vehicles to export to a country outside the European Union must be completed through an authorised forwarding agent with relief from VAT.
This website and these General Terms and Conditions are governed by French law. In the event of a dispute, the consumer may, at their discretion, refer the case either to one of the courts with territorial jurisdiction according to the French Civil Procedure Code, the court for the place where they were living when they entered into the contract or the place where the event giving rise to potential claim occurred.
